Terms and Conditions of Image Use and Gallery Access
By accessing this gallery, entering your email address, downloading any digital files, or purchasing physical prints, you agree to be bound by the following Terms and Conditions between Desiree Hernandez (the "Photographer") and you (the "Client" or "Gallery Visitor").
1. Copyright Ownership and Intellectual Property
All images, text, and media contained within this online gallery are the exclusive property of Desiree Hernandez and are protected under international copyright laws. The Photographer retains full legal copyright ownership of all images at all times.
2. Personal Use License
Upon downloading images from this gallery, Desiree Hernandez grants the Client a non-exclusive, non-transferable, perpetual license to use the images for personal, non-commercial purposes only.
- Permitted Uses: Printing physical copies for personal display, creating personal albums, archiving for personal backup, and sharing on personal social media accounts.
- Prohibited Uses: Selling images, entering images into photography contests, licensing images to third parties, or using images for commercial, corporate, marketing, or business advertising purposes without explicit, written permission from the Photographer.
3. Image Integrity and Social Media Sharing
When sharing images from this gallery online, you agree to preserve the integrity of the artwork:
- No Alterations: You may not apply digital filters (including Instagram/TikTok filters), change the color grading, heavily crop, or otherwise modify the images from their delivered state.
- Watermarks: The watermark must remain visible and intact for any original, watermarked images.
- Crediting The Photographer: We kindly request that you tag or credit Desiree Hernandez (Desiree La Fleur Photography @dezzilafleur) when posting images online to any platform.
4. Gallery Expiration, Deletion, and Archiving
Online galleries require server space and are not intended as a permanent digital storage solution.
- Expiration Date: This gallery will remain active and accessible until approximately 90 days from the delivery date.
- Client Backup Responsibility: The Client is solely responsible for downloading all high-resolution files and creating secure, duplicate backups of their images before the gallery expiration date. The Photographer is not responsible for lost, deleted, or unretrievable files after the expiration date.
- Unarchiving Fees: Requests to unarchive and re-upload a deleted gallery will incur a fee of $25, subject to file availability.
5. Digital Delivery and RAW Files
The high-resolution digital files delivered in this gallery represent the final, polished product of the Photographer's work. Unedited, uncompressed, or RAW files will not be provided under any circumstances, as they are considered unfinished business assets.
6. Print Ordering and Lab Quality
Physical prints, canvases, and products purchased through the integrated gallery store are fulfilled by professional, third-party labs.
- Color Accuracy: The Photographer cannot guarantee exact color matching or print quality if files are downloaded and printed at external consumer labs (e.g., drugstores or supermarkets). But The Photographer will provide the best service and counsel upon any errors of the third-party lab.
- Product Liability: For items ordered directly through this Pixieset store, please contact the Photographer immediately if your items arrive damaged or with manufacturing defects.
7. Data Privacy and Communication
To access this gallery or download files, you may be required to input your email address. By entering your email, you acknowledge that Desiree Hernandez and Pixieset collect this data to manage your user experience (such as remembering your "Favorites" list and shopping cart). Your information will be handled securely and will never be sold to third parties.
